(The Company) is a specialist Executive recruitment business which provides permanent, and contract work-finding and personnel finding services to its Candidates and Clients. The Company must process personal data (on occasion including sensitive personal data) so that it can provide these services – in doing so, the Company acts as a data controller. The Company must have a legal basis for processing your personal data. For the purposes of providing you with work-finding or personnel finding services and/or information relating to roles relevant to you, we will only use your personal data in accordance with the terms of the following statement.


Our services

• A managed service offering, where bespoke sourcing and managed recruitment solutions are provided to meet the needs of the client.

• The placing of candidates with clients in permanent and fixed term contract positions.

• Candidate and client consented consultancy support and development provided by Associates of Nikki Blackhurst Ltd. e.g. Coaching, Onboarding, Psychometric Evaluation


Collection of personal data

We collect personal data for the following types of people to allow us to undertake our business:

• Prospective and placed candidates for permanent or contract roles

• Prospective and live client contacts

• Supplier Contacts to support our services

• Consultants

• Personal Data may also be collected from Third parties that the Company contacts for verification purposes. For example, this may include reference requests taken from former employers, professional associations or bodies. This data will not be requested or collected without your prior consent.


Where we obtain your information We may obtain information from several locations:

• When you register with us or apply for a position

• When you correspond with us by phone, email or otherwise

• When you are referred by a friend or colleague

• Your online profiles e.g. LinkedIn


What Information is collected?

The organisation collects a range of information about you. This includes:

Candidate:

• Your name, address and contact details, including email address and telephone number

• Details of your qualifications, skills, experience and employment history

• Information about your current level of remuneration

• Information about any specific requirements you may have, in order to make reasonable adjustments during the recruitment process

• Information about your entitlement to work in the UK


Client:

• Company address contact names and relevant associated phone numbers in line with a specific piece of recruitment

• Company information provided by the client for recruitment purposes

• Role descriptions provided by the client for recruitment purposes.


Purpose of processing personal data


The Company will collect your personal data (which may include sensitive personal data) and will process your personal data for the purposes of providing you with recruitment services. On occasions this may also include – sensitive personal information such as passport and visa verification.

Legal basis for processing Our legal basis for processing of personal data is our legitimate business interests, although we rely on contract, legal obligation and consent for specific uses of data.


We rely on contract if we are negotiating or have entered into a placement agreement with you or the organisation or any other contract to provide services to you or receive services from you or your organisation. We will rely on legal obligation if we are legally required to hold information on you to fulfil legal obligations.


We will in some cases rely on consent for particular uses of your data and you will be asked for express consent, if legally required. For example, permission to introduce you to a client if you are a candidate.


Legitimate interests

Nikki Blackhurst Ltd. will only use your personal information to administer your account and to provide you with recruitment services. If you are looking for employment or have posted your professional CV information on professional networking sites, we reasonably assume that you are happy for us to collect and otherwise use your personal data to provide recruitment services to you. During an offer process, your new employer may also want to

confirm your references, qualifications etc. to the extent that this is appropriate in accordance with the law.


Your rights

Please be aware that you have the following data protection rights:

• The right to be informed about the personal data the Company processes on you

• The right of access to the personal data the Company processes on you

• The right to rectification of your personal data

• The right to erasure of your personal data in certain circumstances

• The right to restrict processing of your personal data

• The right to data portability in certain circumstances

• The right to object to the processing of your personal data that was based on a public or legitimate interest

• The right to withdraw consent at any time


Recipient(s) of data

As required under GDPR, we will only share your information with prospective employees with your express consent. The Company may also share your personal data and/or sensitive personal data with trusted third parties where we have retained them to provide services that you or our clients have

requested, such as: reference, qualification and reference checking services (as required), verification of the details you have provided from third party sources, psychometric evaluations or skills tests. These third parties comply with similar and equally stringent undertakings of privacy and confidentiality as Nikki Blackhurst Ltd.


Statutory/contractual requirements

Your personal data is required by law and/or a contractual requirement (e.g. our client may require this personal data), and/or a requirement necessary to enter into a contract. You are obliged to provide the personal data. Failure to do so would result in The Company being unable to provide you with the recruitment and/or related intermediary services.


Data Retention

We will delete personal data from our system if we have not had meaningful contact with you for five years (or for such longer period as we believe in good faith, that the law or relevant regulators require us to preserve your data). After this period, it is likely that your data will no longer be relevant for the purposes it was collected. We will consider there to be meaningful contact with you if you submit your updated cv to Nikki Blackhurst Ltd. We will also consider it meaningful contact if you communicate with us about potential roles, either verbal or written communication or engage with any marketing communications.


Under data protection regulations (GDPR) we are required to keep the data we hold accurate and, where necessary, up to date. As such we will make every effort to communicate with you to ensure your data is up to date and accurate.


Data Storage and Processing

All of the personal data we hold about you will be processed in the United Kingdom and accessed via our cloud-based CRM system. We take all reasonable steps to ensure that your personal data is processed securely and prevent unauthorised access to, and misuse of your personal data.

Data Access Requests You may ask us to confirm what information we hold about you at any time, and request us to modify, update or delete such information. If you wish to have access, there will be no administration charge and the request should be fulfilled within 30 Days. To make such a
